Ed Code 44014

Assault on an Employee

California Education Code § 44014 requires school employees to report any threats or attacks against school staff to law enforcement. If a student or someone else threatens or harms a teacher or school worker, the incident must be reported to help ensure safety on campus. This law is meant to protect educators and staff by making sure serious incidents are documented and handled appropriately.

Teachers holding student to account for behavior

Teachers have the authority to maintain order and discipline in the classroom and on school grounds. It essentially gives teachers the responsibility to ensure student safety and allows them to use reasonable force if necessary to protect students, maintain order, and prevent harm. However, this does not give teachers unlimited power—any actions taken must be within legal and ethical boundaries.

These laws help keep schools safe by allowing staff to remove dangerous objects from students and involve authorities when necessary.

Ed Code 49079

Teacher informed of disciplinary action

California Education Code § 49079 requires schools to inform teachers if a student has engaged in violent or dangerous behavior in the past three years. This helps teachers be aware of potential safety concerns in the classroom. However, the information must be kept confidential and only used to protect students and staff. The goal is to ensure a safe learning environment while respecting student privacy.

Defense of a Public Employee

California Government Code § 995 states that public employees have the right to legal defense provided by their employer (a government agency) if they are sued for actions they took while performing their job duties. However, this protection does not apply if the employee was acting outside their official duties, engaging in misconduct, or breaking the law. Essentially, if a government worker is sued for doing their job properly, the government will cover their legal defense.

6401.9. California SB 553 requires California employers to establish, implement, and maintain at all

times in all work areas an effective Workplace Violence Protection Plan (WVPP).
